Terms of Service

1. Agreement to Terms

By accessing or using MigrateWeb's website migration services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services Description

MigrateWeb provides professional website migration services including:

• WordPress site migrations
• E-commerce platform transfers (Shopify, WooCommerce, etc.)
• Custom website migrations
• Domain and DNS configuration
• Post-launch warranty fixes

3. Service Agreement

3.1 Scope of Work

The specific scope of migration services will be outlined in your service agreement or quote. Additional services outside the agreed scope may incur extra charges.

3.2 Client Responsibilities

• Provide accurate and complete information
• Grant necessary access to source and destination servers
• Maintain backups of your data
• Respond to requests for information timely
• Ensure legal ownership of content being migrated

3.3 Timeline

Starter migrations are delivered in 5 business days and Professional migrations in 7 business days, counted from the day we receive the deposit and the access we need. Enterprise delivery dates are set in the written quote. Delays in access or answers from you move the date by the same amount.

4. Payment Terms

4.1 Pricing

The Starter plan costs $99 and the Professional plan $299, as listed on the pricing page. Enterprise and other complex migrations receive a custom quote. The price in your written quote is fixed.

4.2 Payment Schedule

• 50% deposit required to begin work
• Remaining 50% due upon completion
• Payment by the methods listed on your invoice

4.3 Refund Policy

We offer a money-back guarantee if we cannot complete your migration as agreed. Refunds are not available after successful migration completion.

5. What We Deliver

• A planned cutover designed to keep downtime minimal (when technically feasible)
• Data integrity maintained throughout the process
• A post-migration warranty: 30 days on Starter, 90 days on Professional, and 1 year on Enterprise
• SEO checks (URLs, meta data, redirects)

6. Limitations of Service

MigrateWeb does not:

• Guarantee compatibility with all third-party plugins or custom code
• Provide ongoing maintenance after the warranty period, unless agreed separately in writing (ongoing support is quoted separately)
• Take responsibility for pre-existing issues in your website
• Cover costs for third-party licenses or services

7. Intellectual Property

7.1 Client Content

You retain all rights to your website content. You grant us temporary access solely for migration purposes.

7.2 Our Property

All MigrateWeb tools, processes, and documentation remain our intellectual property.

8. Confidentiality

We maintain strict confidentiality of your data and business information. We will not disclose, share, or use your information except as necessary to provide our services.

9. Limitation of Liability

To the maximum extent permitted by law, MigrateWeb's total liability shall not exceed the amount paid for the services. We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits or business opportunities
• Data loss due to circumstances beyond our control
• Third-party service failures

10. Indemnification

You agree to indemnify and hold MigrateWeb harmless from any claims arising from:

• Your breach of these terms
• Your violation of any laws or third-party rights
• Content you provide for migration
• Your use of our services

11. Termination

Either party may terminate services with written notice. Upon termination:

• Payment for completed work remains due
• We will provide any completed work to date
• All access credentials will be returned or destroyed

12. Dispute Resolution

Any disputes shall first be addressed through good faith negotiation. If unresolved, disputes shall be settled through binding arbitration in accordance with applicable laws.

13. Governing Law

These terms are governed by applicable international law and the laws of the jurisdiction where services are provided, without regard to conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these terms at any time. Changes become effective upon posting to our website. Continued use of services constitutes acceptance of modified terms.

15. Severability

If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These terms, along with any service agreement or quote, constitute the entire agreement between you and MigrateWeb regarding our services.
